1. Parties and Scope

These Terms of Service apply to anyone ("Client", "you") who purchases or uses the web design, application development, and related software services ("Services") offered by kymcu ("we", "us") through kymcu.com. By purchasing or using the Services, you agree to these terms.

2. Services Offered

kymcu provides website and custom software development services for businesses. Our core packages include:

  • Essential Business Website — corporate/catalog website, mobile-responsive design, basic SEO foundation.
  • Corporate Web Design & CMS Integration — custom-designed corporate website with a content management panel.
  • Application Development — custom business applications, client/admin panels, API integrations.

The exact scope, timeline, and price of each project are confirmed with the client before the order and documented in writing (via email or the payment link description).

3. Pricing and Payment

The Essential Business Website package starts at $429.99 USD; final pricing depends on project scope (page count, integrations, custom development needs) and is confirmed during the proposal stage. Payments are collected by credit card through our payment infrastructure provider, Creem (Merchant of Record), which is responsible for collecting and remitting applicable taxes (VAT/sales tax). Prices are exclusive of tax unless stated otherwise; any applicable tax is shown separately at checkout.

4. Cancellations and Refunds

Payments made before work begins are refundable on request if work has not yet started. Once work has begun, the remaining balance is refunded net of work already completed. Refund requests must be sent in writing to [email protected] and will be reviewed within a reasonable timeframe.

5. Delivery and Revisions

Delivery timelines are agreed with the client at project start and may shift based on delays in client-provided content or feedback. Each package includes a set number of revision rounds as specified at the proposal stage; additional revisions may be billed separately.

6. Intellectual Property

Once the project fee is paid in full, usage rights to the delivered custom design and code transfer to the client. kymcu retains rights to general-purpose tools, libraries, and internal infrastructure components used during development.

7. Limitation of Liability

kymcu commits to providing the Services with reasonable care and skill, but is not liable for outages or errors originating from third-party services (hosting providers, payment infrastructure, external APIs). kymcu's total liability is limited to the amount paid for the relevant project.

8. Changes

These terms may be updated from time to time. The current version is always available on this page. Material changes affecting ongoing projects will also be communicated by email.
